Variation

Handy Distribution (“the Company”) will enter into a contract for the supply of goods and/or services bound by these terms and conditions, which shall prevail not withstanding any others accepted as a custom of trade or incorporated in any order by the purchaser (whether written or oral and irrespective of dates). Unless a variation of these terms and conditions is accepted and signed by a director of Handy Distribution. 

Delivery

A. All orders will have a £7.95 + Vat delivery charge.
B. Delivery shortages, damages or any mis-delivery of goods of any kind must be notified via email within 48hrs of the delivery. 

C. Every effort will be made to deliver the goods on time. However, we will not be liable for any loss or damage suffered by you through any reasonable or unavoidable delay in delivery.

Guarantee or Failure

A. Competition goods are supplied for specialist use and are subject to extreme heat and stress whilst in use. Life expectancy and durability are greatly reduced and purchasers should note that any claim for failure/wear, shall not be entertained by the Company. It is acknowledged by the buyer of such goods that the foregoing statement shall be a relevant and important issue in any claim brought against the Company and the Company shall, in turn, place importance upon this clause. In addition, parts connected to parts supplied by this company may be placed under stress where

specialist/competition parts are used, and purchasers should take advice from experts prior to

purchase. No guarantee is given on parts used in competition races, practise or testing.

B. The company accepts no liability in respect of failure to supply or other interruptions caused by

matters beyond the reasonable control of the company, including but without limitation, strikes,

lockouts, civil disputes, acts of God, war or actions by third parties.

Retention of Title Clause

The title in goods supplied remains the property of G J HANDY & CO LTD until payment is received in full. Additionally, the Seller reserves the right of entry to the Buyer’s premises for the purpose of repossession of any goods supplied at any time where a balance remains outstanding or any other sum owing by the Buyer to the Seller has not been paid.

This clause to stand in the event of Bankruptcy, Winding-up resolution, or the appointment of a Receiver or Liquidator.
